EACC Submits Investigation file on KEMSA COVID-19 Procurements to ODPP

Introduction
The Ethics and Anti-Corruption Commission (EACC) has today, Friday the 18th September 2020, submitted the first investigation file in respect of irregular procurement and fraudulent payments for acquisition of Covid-19 emergency equipment worth Kshs. 7.8 Billion by Kenya Medical Supplies Authority (KEMSA). The the has been delivered to the Office of the Director of Public Prosecutions (ODPP), with appropriate recommendations pursuant to section 35 of the Anti-Corruption and Economic Crimes Act, the Commission.
Findings
Investigations conducted by EACC established the commission of offences arising from failure to follow the Public Procurement and Asset Disposal Act (PPADA) as well as actions contrary to the Public Finance Management Act (PFMA).
Recommendations
EACC has recommended criminal charges against the concerned individuals for offences under the Anti-Corruption and Economic Crimes Act, 2003, the Public Procurement and Asset Disposal Act (PPADA) and the Public Finance Management Act (PFMA) and the Penal Code. Further Action Inquiries into other aspects of the offences alleged are ongoing and the files will, similarly, be submitted to the Director of Public Prosecutions (DPP) upon conclusion of investigations.
