Benson Wafula Criminal Prosecution to Go On

The Court of Appeal has declined to stop criminal prosecution against Mr. Benson Wafula, who is accused of illegally and fraudulently processing claims amounting to Sh11,212,717. Mr. Wafula, a former Company Secretary at Nzoia Sugar Company and 7 others were arraigned before Bungoma Magistrates Court in 2017, whereupon they pleaded not guilty.
The Court of Appeal agreed with objection raised by EACC and ODPP that Mr. Wafula’s application was incompetent and that there was no compelling reason to believe the accused persons would not get a fair trial. The accused persons will now continue to face charges of willful failure to comply with the applicable laws relating to management of public funds.
