Kakamega Land Illegally Allocated Reverts Back to the Public

The Ethics and Anti-Corruption Commission filed a suit challenging illegal allocation of public land reference Kakamega Municipality/ Block III/245 to a private developer James Musau Kiva. The land, upon which a government house is erected, was public property held in trust by Kakamega Municipal Council and was reserved for housing civil servants.

Situated in Milimani area of Kakamega, the land was allocated to James Musau Kiva contrary to provisions of Government Lands Act. The Court entered judgment in favour of the Commission after being satisfied that it had proved its case against Kiva. The Court agreed with arguments presented by @EACCKenya and ruled that the title issued to the private developer was unlawful.

Subsequently, the court issued orders directing the land registrar Kakamega to cancel the title issued to Kiva. The court further issued a permanent injunction restraining Kiva and his agents from trespassing or dealing in any way with the property. The court declared that the lease issued to Kiva on 31st August 1999 is null and void. The land will revert to public use.
